The protection of your personal data is very important to us. We process your personal data in line with the provisions set out in the General Data Protection Regulation (“GDPR”), the Austrian Data Protection Act (Datenschutzgesetz, “DSG”) and as set out in the Austrian Telecommunications Act (“TKG 2021”).

Website

The website is operated by cognify GmbH itself.

Contact

If you contact us by email, online through our contact form or by telephone, we process the data you have transmitted exclusively to process your request. If you contact us, we assume that you are inquiring about our services or are interested in them or that a customer relationship already exists. We therefore refer to the legal basis according to Art 6 Para 1 lit b GDPR. The collection of your data is necessary in order to be able to process the request. You also provide your data voluntarily. We use the services of Google Cloud EMEA Ltd in Ireland (EU) to receive and send e-mails, with which we have concluded a data processing agreement (Art 28 GDPR) and the EU standard contractual clauses. We only store the data for as long as it is necessary to either fulfill the purpose of your request or due to applicable legal provisions (e.g. UGB, ABGB...).

Customers

We process data transmitted by customers for the purpose of contract processing, insofar as this is necessary for the establishment, implementation and fulfillment of the contract as well as for the implementation of pre-contractual measures (Art 6 Para 1 lit b DSGVO). This includes master and contact data as well as order data and financial data on the invoice recipient. Within cognify GmbH, this data is only passed on to those persons who require this data to fulfill contractual or legal obligations and to protect legitimate interests. The data is also transmitted to our tax consultants, insurance companies, banks, collection agencies, authorities and, in certain cases, to legal representatives and courts. For data processing, we partially use the services of the Google Cloud platform of Google EMEA Ltd in Ireland (EU) with the exclusive storage zone in Frankfurt, Germany. In principle, the data processors we work together with are contractually obliged in particular to process your data only to the extent of the service provision and to treat it confidentially. The data is stored for the entire duration of the business relationship, from initiation to completion, in accordance with legal obligations such as storage and documentation requirements (especially UGB, BAO) and statutory limitation periods (especially ABGB).

Application Documents

If you apply to us, the data you provide will be processed by us for the purpose of processing and handling your application. This processing is based on pre-contractual measures (Art 6 Para 1 lit b GDPR). The data is stored from receipt of the application up to six months after the end of the application process due to the applicable legal provisions. Your consent will be obtained in advance for any longer record keeping, which you can revoke at any time by sending an email to office@cognify.ai.

Rights of the Data Subject

You have the right of access, rectification, erasure or restriction of the processing of your stored data at any time, a right to object to the processing and a right to data portability in accordance with the requirements of data protection law (Articles 15-22 GDPR). If you wish to exercise any of these rights, please contact us (office@cognify.ai). You have the right to complain to the data protection authority (www.dsb.gv.at) if you believe that your personal data is not being processed lawfully.
